have followed arizona and enacted their own laws, my home state of georgia has, alabama has, utah has, indiana has, and in each of those cases courts, except for alabama and in each of those cases courts have enjoined the enforcement of the act on the doctrine of preemption and alabama stated its decision while it further studies the question. no court has upheld one of these statutes. the national association of state legislature, national council state legislatures reports that over 30 states have significant immigration legislation pending, and so there's an obvious need for guidance here. the one caveat i would offer is that this involves the question of preemption, the issue in these cases is not racial profiling, a lot of public discussion centers on that, but the issue in these cases is whether or not these laws are consistent with federal statutes. and the court might well think that congress is going to get around to addressing this issue and it's congress that ought to be providing the guidance. so with that caveat in mind that the court might decide to sort of sit back for a while a
